These Terms of Service ("Terms") form a binding agreement between you and iMagic Nexa ("we", "us", "our"). By creating an account or using the iMagic Nexa app or website (the "Service"), you agree to these Terms.
1. Eligibility and account rules
- You must be at least 13 years old (or the minimum age in your country) to create an account.
- You are responsible for keeping your login credentials secure. You must not share your account, sell it, or let others use it.
- Each account may be actively signed in on up to two devices at a time.
- Each account may create a maximum of two standard profiles and one Kids profile.
- You must provide accurate information and keep it up to date.
2. Subscriptions, billing, and renewals
- Paid access is offered as weekly, monthly, or yearly subscriptions. Prices are shown at checkout.
- Payments are processed by Paystack. We never see or store your card details.
- Subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel first.
- Applicable taxes may be added at checkout.
3. Cancellation
- You may cancel your subscription at any time from the "My Subscription" page in the app.
- Cancellation stops future renewals. Your paid access continues until the end of the current billing period.

4. Acceptable use
You agree not to:
- Copy, download, record, re-transmit, sell, or redistribute any content from the Service.
- Circumvent, disable, or interfere with any security, DRM, geo-restriction, or access-control feature.
- Scrape, crawl, or use automated tools to access the Service without our written permission.
- Upload, share, or transmit content that is unlawful, infringing, harassing, or harmful.
- Use the Service to violate any law, regulation, or third-party right.
5. Intellectual property
The iMagic Nexa name, logo, interface, code, and original content are our property or licensed to us. Movie and series metadata, artwork, and playback references remain the property of their respective rights holders. Nothing in these Terms transfers any intellectual-property rights to you. Your license to use the Service is limited, personal, non-exclusive, non-transferable, and revocable.
6. User-generated content
If you post reviews, ratings, chat messages, or any other content on the Service, you grant us a worldwide, royalty-free, non-exclusive license to host, display, and moderate that content for the purpose of operating the Service. You are solely responsible for what you post and warrant that it does not infringe any third-party rights or violate any law.
7. Third-party services
The Service may link to or embed third-party content, providers, and platforms. We are not responsible for third-party content, availability, or practices. Your use of any third-party service is governed by that provider's terms.
8. Disclaimers
The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any specific title will remain available.
9. Limitation of liability
To the maximum extent permitted by law, iMagic Nexa and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service. Our total aggregate liability for any claim arising out of or related to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) US$50.
10. Indemnification
You agree to indemnify and hold iMagic Nexa harmless from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.
11. Account suspension and termination
- We may suspend or terminate your account, without refund, if you breach these Terms, engage in fraud, abuse the Service, or otherwise create risk or legal exposure for us or other users.
- You may terminate your account at any time by contacting support. Termination does not entitle you to a refund of amounts already paid, except as required by law or by our Refund Policy.
- Sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, indemnification, governing law) survive termination.
12. Governing law and dispute resolution
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will first be addressed by good-faith negotiation between you and us. If not resolved within 30 days, the dispute will be finally settled by binding arbitration in Lagos, Nigeria, in English, under the Arbitration and Mediation Act. You and we each waive any right to a jury trial or to participate in a class action, to the fullest extent permitted by law.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted in the app and, where required, notified by email. Your continued use of the Service after changes take effect constitutes acceptance.
